The Settlement Language Lab

A masterclass for divorce attorneys on the retirement division language that gets defined contribution orders rejected, and how to catch it before the agreement is signed. Taught by Denisa Tova-Liebman.

Most retirement problems begin before the order is ever prepared. Vague "marital share" language, historical valuation dates, equalization wording, and plan terms that do not match the account lead to rejected orders, delays, and client frustration. This lab helps attorneys spot those issues in 401(k)s, 403(b)s, IRAs, and similar defined contribution plans while the agreement can still be fixed.

What the lab covers

The session works through the retirement division language that commonly fails at plan review: how "marital share" gets defined so an administrator can act on it, why gains and losses wording changes what actually transfers, the difference between a percentage award and a dollar award and when each one fails, and the plan terms that have to match the account rather than a template. The focus is defined contribution plans and IRAs, where forensic tracing and clean drafting carry the result.

Divorce attorneys who draft or review retirement division language before settlement. The lab is case-driven and built for attorneys in active practice, not a theory survey.

The lab versus the review service

The lab teaches attorneys to recognize the issues themselves. The settlement language review is case work, where TOVA reviews the language in a specific matter before signing. They are related but separate.

CLE credit

The material is written and delivered to CLE depth. When a law firm, bar association, or other approved provider sponsors the session, it can be structured to qualify for CLE credit under that provider's accreditation. TOVA presents the material; credit is awarded through the sponsor.
